Employment Equity

Employment Equity compliance involves ensuring that designated employers ( employers with 50+ employees), meet their obligations relating to fair employment practices, the elimination of unfair discrimination and, where applicable, affirmative action and employment equity reporting.

Labour Quest assists employers with understanding and implementing their Employment Equity obligations, including employment equity planning, monitoring, documentation, consultation and statutory annual reporting requirements applicable to the employer.

Occupational Health and Safety (OHS) Compliance

Occupational Health and Safety compliance is essential to protect employees from workplace injuries, illnesses and other safety risks, while ensuring that the employer meets its legal obligations under South African OHS legislation.

Employers should have an effective OHS system in place that includes a written OHS policy, workplace risk assessments, appropriate OHS appointments and responsibilities, trained health and safety representatives where applicable, first-aid facilities and trained first-aiders, fire and emergency procedures, workplace inspections, incident and accident reporting procedures, appropriate OHS training and proper recordkeeping. Employers must also ensure that identified risks are addressed and that corrective measures are implemented and monitored.

Labour Quest assists employers with the practical implementation and maintenance of their OHS requirements, including the preparation and maintenance of safety files, workplace risk assessments and workplace inspections. Safety files should contain the relevant OHS documentation and records required for the workplace and, where applicable, for specific projects, sites or contractors. Risk assessments assist in identifying hazards, evaluating workplace risks and implementing appropriate control measures. Workplace inspections help identify unsafe conditions, verify that required controls are being implemented and ensure that corrective actions are recorded and followed up.

These services can assist employers in establishing a structured OHS system and maintaining evidence that safety requirements are not merely documented, but are actively implemented, monitored and reviewed.

For employers with employees working remotely, working-from-home risks should also be considered, including workstation ergonomics, electrical safety and appropriate procedures for reporting work-related incidents.

Effective OHS compliance is not simply about having policies and documents on file. Employers must be able to demonstrate that OHS measures are actively implemented, monitored and reviewed, and that identified risks and deficiencies are appropriately addressed.

POPIA / PAIA

The Protection of Personal Information Act (POPIA) requires employers to protect the personal information of employees, clients, applicants, service providers and other individuals whose information they process. Employers should have appropriate measures in place to ensure that personal information is collected, used, stored, shared and disposed of lawfully, securely and only for appropriate purposes.

Essential POPIA measures include a POPIA/privacy policy, appointment of an Information Officer, personal information and processing records, appropriate consent and/or privacy notices where required, access controls and security measures, procedures for dealing with data breaches, retention and secure destruction procedures, and appropriate agreements with third parties that process personal information on the employer’s behalf. Employees should also receive appropriate POPIA awareness and training.

Labour Quest assists businesses with understanding and implementing their POPIA and PAIA compliance obligations. Services include Information Officer registration, assistance with the required annual Information Officer submission, development and review of POPIA and privacy policies, compliance documentation and records, implementation of practical POPIA processes, and guidance on ongoing compliance requirements.
